1. Introduction

Welcome to Phuket Yachts & Tours ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your use of our website, mobile applications, and services (collectively, "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and Phuket Yachts & Tours regarding your use of our yacht charter and tour booking services.

2. Definitions

For the purposes of these Terms:

• "Booking" means a reservation for a yacht charter, tour, or other service offered through our platform.
• "Customer" or "You" means the individual or entity making a booking or using our Services.
• "Charter" means the rental of a vessel for a specified period.
• "Tour" means a group or private excursion organized by us.
• "Vessel" means any yacht, boat, or watercraft available for charter.
• "Captain" means the certified professional operating the vessel.

3. Bookings

3.1 Booking Process

All bookings are subject to availability and confirmation by us. A booking is not confirmed until you receive a confirmation email or message from our team.

3.2 Accuracy of Information

You agree to provide accurate and complete information when making a booking, including:

• Full names of all participants
• Valid contact information
• Any relevant medical conditions or special requirements
• Number of adults and children

3.3 Age Requirements

You must be at least 18 years old to make a booking. Minors may participate in tours and charters when accompanied by a responsible adult.

3.4 Group Size

The number of passengers must not exceed the vessel's certified capacity. We reserve the right to refuse boarding if the group size exceeds the booked capacity.

4. Payments

4.1 Pricing

All prices are displayed in Thai Baht (฿) and include applicable taxes unless otherwise stated. Prices are subject to change without notice, but confirmed bookings will honor the price at the time of booking.

4.2 Deposit

A deposit of 30% of the total booking amount is required to secure your reservation. For luxury yacht charters, a 50% deposit may be required.

4.3 Balance Payment

The remaining balance must be paid at least 48 hours before the scheduled departure, or on the day of the charter in cash.

4.4 Payment Methods

We accept the following payment methods:

• Credit/Debit Cards (Visa, Mastercard, American Express)
• Bank Transfer
• Cash (Thai Baht)
• PayPal

4.5 Additional Charges

Additional charges may apply for:

• Extended charter time beyond the booked duration
• Damage to the vessel or equipment caused by negligence
• Special requests or additional services
• Corkage fees for personal beverages

5. Cancellations and Refunds

5.1 Customer Cancellations

Cancellations must be made in writing (email or message). Our refund policy is as follows:

• 7+ days before departure: Full refund minus processing fees
• 3-7 days before departure: 50% refund
• Less than 3 days: No refund
• No-show: No refund

5.2 Weather Cancellations

If we cancel due to unsafe weather conditions, you will receive:

• A full refund, or
• Rescheduling to another date at no additional cost

Weather decisions are made at the sole discretion of our captain and are final.

5.3 Company Cancellations

We reserve the right to cancel any booking due to unforeseen circumstances, mechanical issues, or safety concerns. In such cases, you will receive a full refund or the option to reschedule.

5.4 Refund Processing

Refunds will be processed within 7-14 business days using the original payment method.

6. Liability and Insurance

6.1 Insurance Coverage

All our vessels are covered by third-party liability insurance. However, we strongly recommend that customers obtain their own travel and medical insurance.

6.2 Limitation of Liability

To the maximum extent permitted by law:

• Our total liability shall not exceed the amount paid for the booking
• We are not liable for indirect, consequential, or incidental damages
• We are not responsible for loss of personal belongings

6.3 Assumption of Risk

Water activities involve inherent risks. By participating, you acknowledge and accept these risks including but not limited to:

• Drowning
• Injury from water sports equipment
• Marine life encounters
• Sun exposure
• Seasickness

6.4 Indemnification

You agree to indemnify and hold harmless Phuket Yachts & Tours, its officers, crew, and employees from any claims arising from your use of our Services.

7. Conduct and Behavior

7.1 General Conduct

All guests must:

• Follow the captain's instructions at all times
• Behave in a responsible and respectful manner
• Refrain from illegal activities
• Not damage the vessel or equipment

7.2 Prohibited Items

The following items are prohibited on our vessels:

• Illegal drugs or substances
• Weapons of any kind
• Fireworks or explosives

7.3 Alcohol Policy

Moderate alcohol consumption is permitted for guests of legal drinking age (20 years in Thailand). The captain reserves the right to refuse service or terminate the charter if guests become excessively intoxicated.

7.4 Right to Refuse Service

We reserve the right to refuse service or terminate a charter without refund if guests:

• Violate these terms
• Endanger themselves or others
• Damage the vessel
• Engage in illegal activities

8. Intellectual Property

All content on our website and applications, including text, images, logos, and software, is the property of Phuket Yachts & Tours and is protected by copyright and trademark laws.

You may not:

• Copy, reproduce, or distribute our content without permission
• Use our branding or logos without authorization
• Modify or create derivative works from our content

9. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Changes to Terms

We may update these Terms from time to time. Changes will be effective when posted on our website. Continued use of our Services after changes are posted constitutes acceptance of the modified Terms.
